MASTER TERMS & CONDITIONS

These Terms & Conditions (“Terms”) govern all access to, use of, interaction with, submission to, advertising in, contribution to, and distribution of Bellarati Magazine, including but not limited to its website, digital editions, print editions, social media channels, email communications, events, promotions, and all related content and services (collectively, the “Publication”).

Bellarati Magazine is owned by Bellarati & Co.  (collectively, “Bellarati,” “Publisher,” “we,” “us,” or “our”).

 

By accessing, reading, submitting content to, advertising in, purchasing, distributing, or otherwise engaging with the Publication in any form, you agree to be legally bound by these Terms.

 

1. Scope & Applicability: These Terms apply to all parties, including but not limited to:

  • Readers and subscribers

  • Website users

  • Advertisers and sponsors

  • Contributors writers, editors, photographers, creatives

  • Submitters of any content

  • Models and talent featured via third parties

  • Partners, collaborators, and vendors

  • General Users

No separate agreement, submission, email, or communication shall override these Terms unless expressly agreed in writing by Bellarati.

2. Editorial Independence & No Endorsement: All content, including editorial, advertising, sponsored material, submissions, and third-party contributions, is published for informational, artistic, or promotional purposes only. Publication does not constitute endorsement, verification, or approval of any product, service, claim, opinion, or representation. Bellarati makes no warranties regarding outcomes, results, or accuracy of third-party content. All third-party content is published “as submitted.”

3. Readers & General Users:

Readers acknowledge and agree that:

  • Content is provided “as is” and “as available”

  • Use of the Publication is at their own risk

Bellarati is not responsible for decisions, actions, or outcomes resulting from reliance on published content.Lifestyle, fashion, wellness, beauty, travel, and personal development content is not professional advice and should not replace medical, legal, financial, or professional consultation.

4. Website Use & Digital Access: Users may not: Copy, scrape, reproduce, republish, or redistribute content without written permission, Use Bellarati branding, logos, layouts, or likeness without authorization, Misrepresent affiliation with Bellarati.

Bellarati reserves the right to suspend or terminate access to its website or digital platforms at any time without notice.

5. Print & Digital Editions: Print and digital editions may vary in color, resolution, formatting, layout, and appearance due to production, printing, or device differences. Bellarati makes no guarantees regarding color accuracy, image reproduction, or layout consistency. Digital colors may vary from print.

6. Advertising & Sponsored Content: Advertisers are solely responsible for all advertisement content and claims. Advertisers represent and warrant that:

  • Content is lawful, truthful, and non-deceptive.

  • All claims are substantiated where required.

  • All intellectual property, images, likenesses, and trademarks are properly licensed.

  • All required disclosures are included.

  • All rights, licenses, and releases are secured

  • No claims violate applicable laws

Bellarati does not verify advertiser claims and assumes no liability for advertiser products, services, or representations. Bellarati reserves the absolute right to refuse, reject, cancel, edit, resize, reposition, or remove advertisements at its sole discretion.

7. Submissions & Contributions: By submitting any content (including text, images, interviews, artwork, designs, photography, or other materials), submitters and contributors represent and warrant that:

  • They own or control all rights to the submitted materials.

  • Content does not infringe copyright, trademark, privacy, or publicity rights.

  • All necessary permissions, releases, and licenses have been obtained.

Submitters grant Bellarati a perpetual, worldwide, irrevocable, royalty-free license to use, edit, publish, reproduce, distribute, archive, display, promote, and create derivative works from the content in all formats now known or later developed.

Unless expressly agreed in writing:

  • Submissions are non-confidential

  • Submissions are non-compensated

  • Publication is not guaranteed
     

8. Photography, Models & Likeness:  Responsibility for securing model releases, location releases, and likeness permissions,  releases rests solely with the submitting party or advertiser.

Bellarati assumes no responsibility for disputes related to likeness, image rights, or permissions provided by third parties. Bellarati assumes no responsibility for disputes related to image rights.

9. Intellectual Property:  All Bellarati-created content, including layouts, branding, logos, editorial structure, and design elements, remains the exclusive intellectual property of Bellarati. Unauthorized use may result in legal action.

 

A. Vendor / Processor Clause (Coverage Without Naming)

Bellarati may engage third-party service providers for printing, hosting, distribution, fulfillment, analytics, technical support, or administrative services. Such providers act solely on Bellarati’s instructions, acquire no ownership rights, and assume no editorial or legal responsibility for content.

10. Third-Party Links & Platforms: Bellarati is not responsible for third-party websites, booking platforms, payment processors, or external services linked or referenced. Use of third-party platforms is at the user’s own risk and subject to those platforms’ terms.

11. No Guarantees: Bellarati makes no guarantees regarding:

  • Readership or exposure

  • Advertising performance or conversions

  • Placement prominence

  • Editorial selection

  • Distribution reach

  • Specific circulation, distribution reach, audience size, readership metrics, or performance outcomes for any editorial feature, advertising placement, or content inclusion.

12. Limitation of Liability: To the fullest extent permitted by law, Bellarati shall have no liability whatsoever for any claims, losses, damages, costs, or expenses arising out of or related to the Publication, including content, advertisements, submissions, errors, omissions, delays, or non-publication. In no event shall Bellarati be liable for indirect, incidental, consequential, special, punitive, or exemplary damages, regardless of theory of liability. If liability is imposed notwithstanding the foregoing, Bellarati’s total liability shall be strictly limited to the amount paid, if any, to Bellarati for the applicable content or advertisement.

 

13. Indemnification: All users, readers, advertisers, submitters, contributors, and partners agree to indemnify, defend, and hold harmless Bellarati Magazine, Bellarati & Co., Publishing partners, and their owners, officers, employees, and affiliates from any claims, damages, liabilities, costs, or expenses (including attorneys’ fees) arising from their participation, submissions, advertisements, or violation of these Terms.

14. Right to Edit, Refuse, or Remove: Bellarati reserves the unrestricted right to edit, refuse, remove, or discontinue any content or advertisement at any time for editorial, legal, or business reasons.

15. Governing Law & Venue: These Terms shall be governed by and construed in accordance with the laws of the State in which Bellarati operates, without regard to conflict-of-law principles. Venue shall lie exclusively in that jurisdiction.

16. Entire Agreement: These Terms constitute the entire agreement governing all interaction with the Publication and supersede all prior communications or understandings.

18. Editorial & Content Approval
All submissions, features, advertisements, and creative materials are subject to final approval by Bellarati Magazine’s editorial and creative teams. Publisher reserves the sole and absolute right to approve, decline, edit, or remove any content at its discretion.
Approval is not guaranteed by submission alone.
 

19. Content Guidelines
Submitted content must not include:

Political or partisan messaging

Hate speech, harassment, or discriminatory content

Nudity, sexually explicit content, or pornography

Illegal, harmful, or prohibited products or services

Violence, self-harm, or graphic imagery

Misleading, false, or unsubstantiated claims

Publisher reserves the right to update content standards at any time.
 

20. Guaranteed Placement Definition
“Guaranteed placement” means that once content is approved and payment is successfully processed, Publisher will reserve space for Client in an upcoming issue. Issue selection, page placement, layout, and final presentation remain at Publisher’s discretion unless otherwise stated in writing.
 

21. Approval & Rejection Rights
Publisher may reject any submission or package purchase at any time and for any reason, including but not limited to:

Content not meeting editorial or brand guidelines

Non-payment or failed payment processing

Failure to submit required materials

Materials submitted after stated deadlines

Poor technical quality or incorrect formatting

Issue capacity limitations

Brand misalignment
 

22. Refund Policy

If content is not approved, any payment made will be fully refunded.

Once content is approved and payment is processed, all sales are final.

No refunds will be issued for client cancellations, missed deadlines, or failure to provide materials.
 

23. Materials & Deadlines
Client is solely responsible for providing all required assets (images, copy, logos, releases, etc.) by the assigned deadline. Failure to do so may result in postponed placement or cancellation without refund.
 

24. Creative Control
Publisher maintains full creative discretion over layout, cropping, editing, headline writing, design, sizing, and placement. Publisher is not obligated to provide proofs unless otherwise stated.
 

25. Rights & Licensing
Client grants Publisher a perpetual, royalty-free, worldwide license to use submitted content, including name, likeness, brand assets, and creative materials, for print, digital, promotional, marketing, social media, and archival purposes.
Client confirms they own all rights or have obtained proper licenses for submitted materials.
 

26. Indemnification
Client agrees to indemnify and hold harmless Publisher from any claims, damages, or legal actions arising from submitted materials or participation.
 

27. Limitation of Liability
Publisher’s total liability shall not exceed the amount paid by Client.
 

28. No Performance Guarantees
Publisher does not guarantee sales results, follower growth, press pickup, engagement metrics, or commercial outcomes.
 

29. Governing Law
These Terms & Conditions shall be governed by the laws of the state in which Publisher is headquartered.
 

30. Acceptance of Terms
Purchase of any package constitutes full acceptance of these Terms & Conditions.

 

Conclusion

These Terms & Conditions constitute the entire agreement between you and Bellarati Magazine regarding your access to and use of our website, services, submissions, features, advertising opportunities, and related offerings. If any provision of these Terms is found to be unlawful, void, or unenforceable, such provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

Bellarati Magazine reserves the right to modify, update, or replace these Terms & Conditions at any time without prior notice. Continued use of our website or services following any changes constitutes acceptance of the revised Terms.
